Former Arrow drivers hit target with settlement
TULSA, Okla. – Nearly 260 former Arrow Trucking Co. drivers have agreed to a $1.58 million settlement with their former carrier, reports Tulsa World.
Hundreds of Arrow drivers were left stranded across the U.S. a few days before Christmas last year when the company’s main creditor froze its fuel credit cards and operating capital.
This past summer a U.S. Bankruptcy Court ruled that Arrow Trucking violated the Worker Adjustment and Retraining Notification Act (or the WARN Act, as it’s commonly known), when it abruptly shut its doors.
Under the Act, companies with more than 100 employees are required to give a 60-day notice of a pending mass layoff or closure. Companies that fail to do so may be held responsible for 60 days of wages per employee.
The drivers’ attorney, Charles Ercole, was unsuccessful in getting the suit certified as a class action representing more than 1,000 Arrow employees.
