New set fines for TDG charges in Ontario

TORONTO — Ontario now has a set fine schedule and an out-of-court plea option for TDG violations under the Dangerous Goods Transportation Act.

What the amendment allows the Ministry of Transport to do to do is give a “ticket” for an offence under the Act, explains an MTO official. In the past the ministry could only initiate a charge “by an information, which required the defendant and officer to appear in court.

The fines are as follows:

— Not able to produce shipping document: $400.00.

— shipping document not in prescribed location: $250.

— Transporting dangerous goods while untrained: $400.

— Permit transportation of dangerous goods by untrained employee: $400.

— Permit transportation of dangerous goods by employee with incomplete certificate or fail to provide certificate to inspector: $250.

— Misleading safety mark or failure to display prescribed safety mark: $400.

— Fail to comply with request of inspector: $400.
